Council will not oppose 1,700 Frome homes at public inquiry to avoid £400,000 legal bill

Somerset Council will not openly fight to prevent hundreds of new homes coming to Frome for fear of incurring a legal bill in excess of £400,000.

A public inquiry will be held in July to determine the fate of the Selwood Garden Community (SGC), comprising 1,700 new homes, commercial space, a primary school and other facilities at the southern edge of the town.

Before the government called in the decision in February, the council had been ‘minded to refuse’ the plans, with its planning committee east stating a list of possible grounds in December 2024 which would have been formalised by planning officers.

But the same committee has now agreed to take a neutral stance at the inquiry – meaning it will offer no evidence against the plans and only contest the level and timing of financial contributions towards local facilities.

Local campaigners begged the council not to take such a stance when the committee convened in Shepton Mallet on Friday 28th March.

Dr Patricia Smith from the Frome and District Civic Society said: “The elephant in the room, which everyone seems to have ignored, is the size of the SGC – and size matters.

“This would be the second-largest development in Somerset; only in Taunton, which has significant transport infrastructure, would you find anything on this scale.

“Quality assurance must be established at the start and, importantly, maintained over time. The proposed design delivery process with SGC is unworkable and frankly bizarre.

“If no evidence is offered against this, that is tantamount to supporting it, as you well know. Given you were minded to refuse this in December before the call-in, it is right for you to oppose it.”

Mark Pollock from the Friends of the River Frome said, “In 2024, figures released by the Environment Agency shows there were spills into the river for over 544 hours from 13 sites around the town.

“Sewage spillage into the river is getting worse, not better, and the existing drainage system is already over-capacity.

“Wessex Water’s lack of objection and reliance on only one planning condition can give little confidence, given the poor track record over sewage spills into the river. This will be magnified by the impact of multiple developers working on site over a 15-year period.

“The proposed playing field within the riverside will be unusable during flooding events, which are becoming more frequent and intense.”

Joe Hannam Maggs from the Stop SGC campaign group said the consortium bringing forward the plans had not been honest with the council over the huge increase in traffic congestion the new homes would create.

He said, “The applicant is suggesting that 30 per cent of residents will car share, when only six per cent of Frome residents do so now.

“We are looking at 82 per cent more traffic at the AM peak and 91.2 per cent more traffic at the PM peak.

“It’s clear that the SGC is simply too big and in the wrong place.”

Following the committee’s February meeting (just 24 hours after the call-in), Frome Town Council entered into further discussion with Land Value Alliances, which is promoting the SGC application on behalf of the landowners’ consortium.

The promoter has agreed to provide the following concessions and additional contributions:

  • Funding to upgrade the B3090 The Butts can be redistributed to “other appropriate highways works” in Frome if it is not needed at this location
  • Additional contributions towards medical facilities in Frome can be secured as the 500th, 1000th and 1500th homes are delivered – and part of the planned community hub will be marketed for a pharmacy occupier within six months of the hub being constructed
  • Affordable housing will be advertised towards people living in Frome or the neighbouring Selwood parish six months before being offered to people living “in a wider radius” of the town
  • More than £718,000 will be provided for additional active travel improvement, bus vouchers or car clubs if “transport modal shift targets are not being met”
  • The main access roads and spine roads into the commercial spaces must be completed swiftly to allow these spaces to be marketed within three years of construction work beginning
  • Money set aside for improvements to Frome Town United Football Academy and Frome Town Rugby Football Club can be recycled into other sports facilities if the clubs do not secure planning permission.

Town councillor Steve Tanner said that these additional provisions had tipped the balance, with the town council withdrawing its formal objection to the SGC.

He told the committee, “We had red lines that needed to be addressed, regarding the lack of infrastructure.

“Since the application was last discussed by the committee, we’ve had the opportunity to discuss these red lines in detail with the applicant, leading us to remove our objections.

“We have a housing crisis and we need more affordable housing. Of course we lament the loss of green spaces, but the government’s higher housing targets lead us to believe that this will be approved by the secretary of state.

“If we all work together and hold the developers to these outline plans, we can achieve an exemplary development which can go some way to meeting Frome’s housing needs.”

Matthew Kendrick from Grassroots Planning (representing the applicant) added: “We genuinely consider this scheme to be exemplary, and we have worked to secure additional contributions since December.

“There is no other site capable of meeting the town’s housing needs.”

Several councillors urged the council to openly contest the appeal, arguing that the scale of the SGC was disproportionate and would not meet local need.

Councillor Michael Dunk (Green, Frome West) said, “This is a proposal of an unprecedented scale for Mendip, and would result in a disproportionate scale of development for Frome. It will significantly degrade the quality of the local landscape.

“The report is asking us to accept that all the housing gains outweighs all the harms in going against our policies. It does not.”

Councillor Shane Collins (Green, Frome East) said: “1,700 houses, 6,000 people and 4,000 cars – it’s a 23 per cent increase in population in one hit.

“This will be a car-based development which is completely at odds with our climate change policies and will probably lead to a one-way system being implemented into Frome town centre in the future.

“If ever there was a case of today’s solutions being tomorrow’s problems, this is it.”

Councillor Helen Kay (Green, Frome East) added: “I don’t believe in the very simplistic supply and demand model for housing – just building more houses is not going to solve the problem, because developers build out deliberately slowly to keep the prices up.

“Because of how our Homefinder system works, people in Bridgwater or Taunton may get the affordable homes rather than the people in Frome, which will not solve our housing crisis.

“By going neutral, we are just weakly supporting the application.”

Councillor Claire Sully (Liberal Democrat, Mendip South) warned that local residents would hold councillors’ feet to the fire if they did not take a principled stand on these proposals.

She said, “Planning and housebuilding is a political football for the government and it seems they are desperate to score a goal – but it will be an own goal and not help this town.

“We want to solve the housing crisis, but it has to be the right development for the people of Frome.

“We will be judged in the future if we don’t stand up for what we believe in.”

Alison Blom-Cooper, the council’s chief planning officer, warned that if the council actively opposed the development and lost the inquiry, it could liable for legal costs which would be “comfortably above £400,000”.

After more than two hours of debate, the committee voted to take a neutral stance at the inquiry by eight votes to three, with one abstention.

Planning inspector Stephen Normington indicated in early-March that the inquiry will be set for 12 days, beginning on 29th July and will include at least one site visit.

The venue for the inquiry will be confirmed by Somerset Council by mid-July.

Two community projects focused on saving money, reducing waste and sharing resources are coming together in Frome with the opening of a new DIY store and the return of the Share Shop.

Both initiatives are being run by local non-profit organisation Edventure and will operate from The Welsh Mill on Park Hill Drive. The new DIY and building materials store, Fromebase, is now open, while Share Frome is preparing to reopen at the site after leaving its previous premises last year.

Store manager Nicky Bragg said, “At a time when rising living costs are forcing many households to think differently about how they spend their money, Fromebase offers a practical solution for anyone looking to improve their home and help the planet without compromising on quality.

“We want people to understand that surplus doesn’t mean poor quality. The store is full of useful, high-quality materials that deserve to be used. We want DIY to feel more affordable, less intimidating and more resourceful.”

  • Cat charity marks 10 years as care unit appeal launched 

A cat welfare charity in Frome that has helped more than 2,500 cats over the past decade is fundraising to build a new intensive care unit.

Cats in Distress, which is celebrating its 10th anniversary this year, now helps more than 400 cats a year and is currently caring for 57 cats, offering medical care, low-cost neutering and rehoming services for strays and cats whose owners can no longer care for them.

Founder Ginny Parratt said there is a need to build a new intensive care unit at its base in Berkley to give rescued cats space to heal and recover away from the main site.

She said, “We feel with more cats being admitted and with cat flu and possible parvovirus coming into the area, we want to have a unit that is in isolation away from the main rescue.

“We’re currently looking after a cat called Ken. Although he is not infectious, he has got a nasty wound and it would be nice to put him away from the general hubbub. It would just be a nicer experience for him to help with the healing process.”

  • Exhibition showcases historic Frome postcards

An exhibition of historic Frome postcards is on display at the town hall, featuring images dating back to 1904.

The exhibition has been launched by local resident Lockhart Murdoch, who has collected 80 postcards from Frome and surrounding areas.

He said, “I have gathered a whole collection of postcards from flea markets, eBay and charity shops since moving to Frome eight years ago. Collecting postcards is one of my passions and I felt like sharing it with other people.”

Lockhart, who is co-chair of Frome Festival, said the town has been popular with postcard photographers for more than 100 years. Postcards in the display date from 1904, 1910 and the 1970s.

  • Frome’s young musicians take over town centre

Young musicians took to the streets in the town for the annual Frome Busks on Saturday 13th June.

The pop-up music event saw musicians work their way around seven stages at Frome Library, Black Swan Arts, Stony Street, Cheap Street, Westway, the Cheese and Grain and Boyle Cross.

Hosted by Frome College and Selwood Academy, the event is supported by Frome Town Council and raises funds for extracurricular music performances, equipment and productions for Frome College students.

Acts included The Shrink, Paris Blue and Fluffy and the Jars, formed at Frome College and soloists including Sam, Christian, Syd, Dora, Lula, Miri, Joe, Annie and Alexa, performing in rotation across the stages between 11am and 2pm.

  • Frome’s Partner Towns Column: Discover Rabka-Zdrój

Hello, I’m Philip Campagna, one of your town councillors. 

This column is the second in a series introducing Frome’s four partner towns, ahead of a planned trip to Murrhardt this summer. This time, we’re focusing on Rabka-Zdrój, in southern Poland.

Frome’s friendship with Rabka-Zdrój began in 2003 and has continued to grow through visits, exchanges and community connections over the past two decades. You may have noticed that Frome has an area dedicated to Rabka in Victoria Park, near the bandstand and with benches to enjoy a beautiful flower bed.

Rabka-Zdrój is located at the foot of the Carpathian Mountains, around an hour south of Kraków. Like our neighbour Bath, it’s a ‘spa town’, a traditional place to relocate for rest and recuperation in the 19th century, especially for children, although references to the health-giving qualities of the area’s water date back to medieval times. It’s a beautiful place, surrounded by forests and rolling hills and a popular destination with walkers and cyclists, as well as winter sports enthusiasts.

  • Climate film draws large crowd to Cheese and Grain

A short film about the climate emergency drew more than 320 people to the Cheese and Grain recently.

‘The People’s Emergency Briefing’ was shown on 21st May, with residents coming together to watch the screening as part of a wider programme of showings at venues across the country.

Following the film, small groups formed to discuss what they had seen, how it made them feel and what they wanted to do together. The discussions were facilitated by 25 volunteers from the community.

Event co-organiser Georgia Clark said, “We wanted to hold with care the wide range of emotional and psychological responses that the climate emergency provokes. The circulation of reactions and ideas in the post-film discussion felt energising and impactful, and a clear indicator that we need to create more space for conversations like these.”

  • Frome Wild Bunch Column: Wildlife garden

Hi, this is Jo from the Wild Bunch. 

Summer has truly arrived and while I often feel like I’m permanently behind with jobs in the garden, I stopped for a moment recently, to simply appreciate what I have created.

Standing amongst the flowers, listening to the constant hum of bees and looking at my ‘Team Wilder This is a Wildlife Friendly Garden’ plaque from Somerset Wildlife Trust, I felt a real sense of pride and purpose.

My garden certainly isn’t neat and tidy in the traditional sense. It’s wonderfully wild. Long grass sways in the breeze, colourful flowers spill into pathways, and every corner seems alive with insects. It feels like an extension of the wider landscape around us – natural and constantly changing, but also a small space of my own that I share with the wildlife around me. I just love it!

  • Musical fundraisers hold annual charity event

A collective of musicians has raised funds for Fair Frome at an annual gig in Victoria Park.

‘Tribe Mini Fest’ saw an afternoon of live music and fundraising last month. Performers included Kit Morton, Paul Kirtley, Bee Owen, Lee Howard, the Up All Night Stars and headliners Cult of the Velvet Rattlesnake, delivering more than four hours of live music ranging from acoustic sets to swampy blues-rock grooves.

The event raised nearly £200 in cash donations on the day, helping support Fair Frome’s ongoing work at the food bank, Food @ Five, Community Pantry and furniture bank.

  • Frome up and running in the Wiltshire Road Race League

Frome Running Club kicked off their summer road racing campaign at the Corsham 10k with 17 runners pulling on the team’s iconic red shirt for the opening fixture.

Frome’s combined results placed the team sixth in Division 1, with three runners completing the course in under 38-minutes.

“I was really pleased to break the 37-minute mark and achieve a personal best for my 10k, especially as it was only a week after the Newport Marathon,” said Michael Gorman. “The league reminds me a lot of my team sport days, with everyone working together to score as many points as possible for the club.

“There is also a ‘B’ league, which makes it accessible and competitive for runners of all abilities. That sense of inclusivity and shared purpose is what really drew me to the club. It has reignited my competitive spirit, while still being done in a very supportive and encouraging environment. The club’s Wednesday interval sessions have really helped me sharpen my speed.”
